Social Media and Elections. The Limits of Law
and the Risks of a Modulated Democracy
This paper, through the analysis of the recent academic discussion about the power of algorithms and the role of social media as digital intermediaries, aims to assess whether, and to what extent, the increasing importance of the role of social media in shaping the public sphere could put at risk some of the fundamental values of democracy. The survey will try to highlight which risks – in terms of ensuring elections are fairly and properly conducted – derive from the specific features of social media platforms. Comparing those risks with the current normative framework, the paper will attempt to emphasize how the regulatory standpoint adopted by European countries is ill-equipped to guarantee the respect of the procedural requirements that liberal theory assumes as essential for democratic regime.
