Modelli di sistemi giuridici e potenzialità dell'informatica giuridica
Model of Legal System and the Potentials of Legal Informatics
La valutazione critica delle potenzialità dei sistemi d'informatica giuridica è basata sull'analisi dei tre modelli di "sistemi giuridici legislativi" e del modello "diritto operativo". I sistemi del diritto legislativo sono definiti in relazione alla validità delle norme: nel sistema SGLE solo le norme emanate dalle autorità competenti sono valide; nel sistema SGCF alle norme valide nel sistema SGLE si aggiungono le norme che si inferiscono dalle prime mediante calcoli di logica formale; nel sistema SGCI alle norme del sistema SGCF viene aggiunta un'altra classe di norme valide, cioè le norme ricavate secondo le direttive sull'interpretazione giuridica. "Diritto operativo" è il diritto che si ritiene applicato nelle, o creato dalle, decisioni degli organi competenti dello Stato. I sistemi d'informatica giuridica sono caratterizzati dalle domande di un utente ipotetico interessato alla validità delle norme che regolano un problema concreto. Le possibilità di risposta a queste domande nel sistema d'informatica giuridica sono basate sulla soluzione dei problemi teorici di validità e sulla tecnica impiegata per il reperimento delle informazioni. L'analisi dimostra che un sistema d'informatica giuridica relativamente soddisfacente dal punto di vista sia pratico che teorico dovrebbe combinare insieme informazioni corrette per il sistema SGLE e per il diritto operativo.
Critical valuation of the potentialities of legal information systems is based on analysis of three models of «legislative legal systems» and of the model of «operative law». The system of legislative la are defined in relation to the validity of the laws: in the SGLE system only laws issued by competent authorities are valid: in the SGCF system to the valid laws in the SGLE system are added the laws that are inferred from the former by means of formal logic calculations: in the SGCI to the SGFC system laws is added another class of valid laws, that is the laws obtained according to instructions on the juridical interpretation. «Operative law» is the laws considered applied in, or created by the decision of competent state bodies. Legal information systems are characterised by the questions of a hypothetical user concerned in the validity of the laws regulating a concrete problem. The possibilities of replies to these questions in the legal information system are based on the solution of theoretical problems of validity and on the technique used of obtaining the information. Analysis shows that a relatively satisfactory legal information system both from the practical and theoretical point of view should combine correct information for the SGLE system and for the operative law.
