Il sistema informativo del Ministero della Giustizia spagnolo nel campo della giustizia penale

The Information System of the Spanish Ministry of Justice in the Field of Criminal Law

L'A. illustra sinteticamente i progetti generali d'automazione elaborati dal Ministero della Giustizia spagnolo per quanto riguarda il sistema della giustizia penale. L'A. descrive con una certa ampiezza la metodologia utilizzata, che è in gran parte originale, anche se fondata sulla teoria generale dei sistemi, sulla cibernetica e sulla dinamica dei sistemi. I progetti, denominati sisipe e sigma, si basano sulla considerazione del Ministero della Giustizia - coi servizi centrali che in esso direttamente rilevato - come sistema gestionale di diversi sistemi operativi svolgenti, con più o meno ampia indipendenza giuridica e operativa, funzioni specifiche in modo conforme ai rispettivi fini istituzionali. A tale scopo i diversi settori dell'amministrazione della giustizia sono ugualmente considerati come se fossero anch'essi dei sistemi operativi, senza pregiudizio per le prerogative inerenti al potere giudiziario. L'impianto di questi progetti richiederà un grande sforzo tecnico ed economico e un lungo lavoro di anni, ma in una certa misura rappresenterà il coronamento della meccanizzazione dei servizi nell'ambito della competenza del Ministero della Giustizia. In particolare il Sisipe, benché il suo impianto operativo integrale rimanga ancora lontano, costituisce il fondamento comune a tutti i lavori di meccanizzazione avviati dal Ministero della Giustizia e inoltre è servito allo sviluppo e alla messa a punto d'una nuova metodologia, applicabile in maniera generale a tutti i sistemi amministrativi di trattamento del flusso dei dati. Importa infine rilevare che, anche se il Sisipe nel suo complesso non ha ancora raggiunto la fase operativa, fin d'ora però esistono diversi aspetti o settori del progetto che sono stati realizzati con risultati soddisfacenti.

In the article the A. synthetically the general projects for automatic data processing of the Spanish Ministry of Justice concerning the criminal law system. The A. gives a full description of the method used, which is largely original, even though it is based on the general theory of the system, on cybernetics and on the dynamics of system. The projects called SISIPE and SIGMA, are based on the consideration of the Ministry of Justice, with the central service which form part of it, as a management system of several operative systems. These carry out, with more or less wide juridical or operative independence, specific functions in conformity with their respective institutional aims. Therefore the various sectors of the administration of justice are considered equally as if they too were operative systems, without prejudice to the prerogatives inherent in the judiciary power. The plant for these projects will require a great technical and economic effort and many years work, but to some extent it will represent the crowning of the mechanization of the services coming within the competence of the Ministry of Justice. In particular SISPE, although its integral operative plant is still far from completion, constitutes the common foundation for the work of mechanization begum by the Ministry of Justice. Moreover it has served for the development and setting up of a new methodology, generally applicable to all the administrative system for processing data flow. Finally it is important to note that, even if SISPE as a whole has not yet reached the operative stage, however, from now on there exist several aspects or sectors of the project that have been put into operation with satisfactory results.
