The Computerized Real Estate Register
Premessa la descrizione del sistema di registrazione dei diritti reali in vigore nella repubblica Argentina prima del 1968 e delle modificazioni ad esso successivamente apportate (decreti legge 17.711 e 17.801 del 1968), vengono illustrati la struttura e il funzionamento del registro della proprietà immobiliare della città di buenos Aires. Tale registro si basa sulla tecnica del "foglio reale", in cui viene assunto come elemento fondamentale di riferimento il bene immobile nella successione delle sue vicende giuridiche, ed è caratterizzato da tre tipi d'annotazioni: una sul foglio reale e le altre, rispettivamente, su microfilm e nelle memorie dell'elaboratore del Centro elettronico cui è affidata la gestione dei dati del sistema. Una speciale macchina consente d'inscrivere direttamente sul foglio reale il negozio giuridico da registrare, perforando nel contempo l'informazione su nastro di carta; i dati contenuti su questo nastro vengono poi trasferiti su nastro magnetico e registrati nelle memorie del Centro. Pur essendo sicuramente perfettibile, il sistema descritto costituisce attualmente, a livello mondiale, una delle realizzazioni più interessanti nel settore. The real estate recording system in force in the Republic of Argentina before 1968 and subsequent changes (law by decree no. 17.711 and no. 17.801, 1968) are outlined. The Author then describes the organizational structure and operation of the estate register of the municipality of Buenos Aires. This register in based on «property cards», each of which contains the legal history of single property and comprises three different kinds of records: one record is made on the property card, one on a microfilm and the third one on the computer memory of the computer center encharged with the data management of the system. A special machine makes it possible to record transactions regarding a given directly on the property card. This information is also punched on a paper strip which is transmitted to a magnetic tape and stored in the computer center memories. Although the system can be improved, it is one of the most interesting realizations in this field in the world. Some appendixes are attached to the article.
