Informatic Techniques and the Free Formation and Expression of Judgement on thePart of Criminal Judges
When dealing with an alleged crime, the judge must first establish the facts, then establish the legal relevancy of these facts and, lastly, identify and interpret the law that applies to the particular case. The iter leading up to the formation of judgement and upon which a «just» decision must be based, involves both the subjects directly or indirectly involved in the reconstruction of the act and the object of the reconstruction and proof. It also includes the means by which such activity is carried out (means of evidence). The increased diffusion of automated data processing can alter the above-mentioned procedures. When required to make a decision on a certain fact the computer will always make the same decision in accordance with the programme used. However, the automatic decision may prove to be erroneous either because of a wrong exposition of the facts or because of a programming failure, to match the facts of the case with the pertinent legal data. If necessary, the imperfect decision of the machine should be rationally corrected by man and this may, in its turn, represent a «cultural» improvement for the computer programme. In particular with regard to the iter of the formation of judgment, the records of the suspect or defendant can be rapidly consulted by the use of automated criminal files. Moreover, the automated retrieval system employed by the Supreme Court far searching civil and criminal law will enable the judge to discover the orientation of existing jurisprudence on each point right from the time the charges are brought. The Police and «Carabinieri» already use computers which can be questioned directly from any part of the country. These supply accurate information on both the physical characteristics of previous offenders and on the characteristics of their modus operandi. According to this automation project the principle of the judge's freedom in formulating the judgement would be unlimited and the free evaluation of evidence would remain unimpaired. On the contrary, it is difficult to conceive in practical terms of automatically controlling the motivation. The present technological standard in this field does not permit a performance of this kind because of the unpredictable forms the motives may assume in the course of their logical development. Lastly, the problems of the legal definition of the case and that of the identification and interpretation of the law that applies have already been solved to a great extent. The basic problem is for the judge to obtain the widest possible range of relevant legislative, doctrinal and jurisprudential information in the shortest possible time.
