A Model for the Dynamics of Legal Systems
Gli Autori tentano di costruire un modello semplificato per la determinazione del contenuto di un sistema normativo dinamico, cioè di un sistema risultante dal gioco reciproco di successivi atti di promulgazione (creazione) e di abrogazione (eliminazione) di norme. Il modello è presentato in forma di diagrammi di flusso che possono essere usati per i programmi dei calcolatori elettronici. La prima parte del programma cerca di risolvere i conflitti tra atti di promulgazione e atti di abrogazione e dimostra che le regole tradizionali (lex superior, lex posterior) non sono sufficienti e richiedono un'integrazione. Nella seconda parte del programma si pongono in evidenza certe conseguenze dell'abrogazione: l'abrogazione di una norma suppone l'eliminazione di tutti gli insiemi di norme che implicano la norma espressamente abrogata; però ciò che resta dopo tale eliminazione può risultare indeterminato. Questa indeterminatezza logica del contenuto del sistema ha gravi conseguenze sull'applicazione del diritto.
The Authors attempt construct a simplified model for determining the content of a dynamic legal system, that is a system deriving from the interplay of successive acts of promulgation (creation) and abrogation (elimination) of laws. The model takes the form of flow diagrams that can be used for electronic computer programmes. The first part of the programme attempts to solve the conflicts between acts of promulgation and acts of abrogation and shows that the traditional rules (lex superior, lex posterior) are insufficient and require integration. The second part of the programme emphasizes certain consequences of abrogation: the abrogation of a law assumes the elimination of the whole body of laws that involve the expressly abrogated law; however what remains after elimination may be indeterminate. This logical indetermination of the content of the systems has serious consequences on the application of the law.
