The Rational Legislator: General Theory and the Socialist Experience

Nel saggio sono prese in considerazione la teoria generale della formazione razionale delle leggi e l'esperienza socialista nel risolvere i problemi a essa attinenti.
Gli obiettivi della formazione delle leggi possono essere qualificati come "omeostatici" - quando si risolvono nella tutela dell'equilibrio sociale - e come "strumentali" - quando si concretano in un cambiamento controllato del contesto sociale in cui la legge opera. Collegata agli obiettivi è la concezione della politica della formazione delle leggi: si parla di "concezione minimalista" quando la legge è considerata solo come uno strumento per realizzare obiettivi già decisi, e di "concezione massimalista" quando, invece,  oggetto d'analisi sono anche le finalità conseguite dalla legge e, più in generale, i valori inerenti alla politica sociale complessiva. All'interno di queste due concezioni si possono distinguere "dichiarazioni valutative" di tipo diverso: "fondamentali" (attinenti alle finalità ultime della legge), "strumentali" (semplici o complesse: X ha valore in quanto è strumentale alla finalità Y o a più finalità insieme), "condizionali" (semplici o complesse; X ha valore in quanto è condizione peril raggiungimento della finalità Y o  di più finalità insieme) e "relativizzate sistematicamente" (X ha un valore S secondo il sistema assiologico AS).
Esistono, inoltre, diversi "modelli di formazione delle leggi" ("descrittivo", "teorico sistematico", "teorico informativo-decisionale", "decisionale-procedurale") e diversi "modelli normativi di formazione delle leggi", basati ciascuno su una distinta ideologia (modello "normativo giuridico", "normativo politico", "normativo etico" e "normativo dottrinale").
Il "modello di formazione razionale delle leggi" richiede che le decisioni legislative siano legittimate (o legittimabili) sulla base della loro coerenza con le premesse (conoscenze teoriche e priorità valutative) del legislatore; esso consiste nella determinazione d'uno o più obiettivi, nell'individuazione degli strumenti (soprattutto giuridici) necessari al loro conseguimento e nella formulazione ed emanazione delle norme giuridiche ritenute funzionalmente più idonee. In un approccio dinamico alla formazione delle leggi si devono però prendere in considerazione anche l'eventuale modificazione degli obiettivi iniziali, la conseguente verifica degli strumenti e l'ordine di successione delle attività di formazione delle leggi.
La regolamentazione giuridica dell'attività di formazione delle leggi dovrebbe avere a suo fondamento il "modello di formazione razionale delle leggi" sopra descritto; essa può ispirarsi alla "concezione direttive" (limitandosi, in questo caso, alla sola enunciazione di direttive vincolanti) o a quella "dottrinale" (estendendosi allora alla formulazione di concetti giuridici fondamentali e di ergole del ragionamento giuridico), alla concezione procedurale o a quella sostanziale (a seconda che prenda in considerazione esclusivamente le modalità di formazione della legge o anche i principi fondamentali a essa relativi), alla concezione ristretta o a quella ampia (la prima restringe l'analisi ai problemi attinenti al processo di formazione della legge fino alla sua emanazione, mentre la seconda tiene conto anche delle difficoltà d'interpretazione e applicazione della norma).
La pianificazione e l'organizzazione della formazione delle leggi, in quanto valgono a porre il legislatore in condizioni di elaborare ed emanare le leggi disponendo del tempo occorrente ad acquisire i dati (tecnici e/o statistici) necessari e a dibattere i problemi assiologici attinenti, sono funzionali alla razionalità di tale processo. Nei Paesi socialisti esiste un particolare tipo di pianificazione che consiste nella sistemazione periodica di determinati settori della legislazione in vigore e comporta l'eliminazione di lacune, incoerenze, contraddizioni, atti normativi superflui o non applicati (desuetudine). Un altro tipo di pianificazione ha invece per oggetto l'attività futura di formazione delle leggi per lunghi periodi di tempo, avendo riguardo allo sviluppo generale dello Stato e della società. Inotre esistono strumenti organizzativi che possono influenzare favorevolmente la formazione delle leggi. In Polonia svolgono questa funzione la Commissione per le attività legislative, il Consiglio legislativo e, per certi aspetti particolari, lo stesso Ministro della giustizia.
Infine viene rilevato che può riuscire di notevole ausilio alla formazione razionale delle leggi la creazione d'un sistema specializzato d'informatica legislativa, atto a fornire informazioni complete e attendibili sul complesso delle leggi in vigore, sull'attività giurisprudenziale e sulle opinioni della dottrina giuridica.

The general theory of the rational formation of laws and the socialist experience in solving the problems related to it are taken into consideration in this article. The objectives of the formation of laws can be defined as «homeostatic» - when they come down to the protection of the social balance - and as «instrumental» - when they materialize in a controlled change in the social context in which the particular law operates. Linked with the objectives is the conception of the policy of the formation of laws: the «minimalist conception» is spoken of when the law is considered to be an instrument for achieving objectives which have already been decided upon and the «maximalist conception», instead, when the end results attained by the law and, more generally, the values inherent in the overall social policy are also the object of analysis. Different types of «evaluative statements» can be distinguished within these two conceptions: «fundamental» (relating to the end results of the law), «instrumental» (simple or complex: X has value in as far as it is instrumental to the end result Y or to several combined end results) and «systematically relativized» evaluative statements (X has a value according to the axiological system AS). Furthermore, there are several models of the formation of laws («descriptive», «systematic theoretical», «informative decision making theoretical», «procedural decision-making») and different «normative models of the formation of laws», each based on a distinct ideology («legal normative», «political normative», «ethical normative» and «doctrinal normative»). The model of the rational formation of laws requires legislative decisions to be lawful (or which can become lawful) on the basis of their consistency with the legislator's premises (theoretical knowledge and evaluative priorities). This lies in the determination of one or more objectives, in the identification of the instruments (mainly legal) required for carrying them out and in the formulation and promulgation of legal norms believed to be functionally more suitable. In a dynamic approach to the formation of laws, the eventual change in the initial objectives, the subsequent checking of the instruments and the order to be followed in the tasks involved in the formation of the laws must, however, also be taken into consideration. The legal regulation of the tasks involved in the formation of laws should have the «model of the rational formation of laws», described above, as its foundation. This may be based on the «directive conception» (restricting itself, in this case, only to the statement of binding directives), «doctrinal conception» (extending then to the formulation of fundamental legal concepts and rules of legal reasoning), on the procedural or substantive conception (according to whether the modalities for the formation of laws exclusively are taken into consideration or whether fundamental principles related to it are also considered), on the restricted or broader conception (the former narrows the analysis down to problems relating to the process of the formation of laws until their promulgation, whilst the latter is aware of the difficulties involved in the interpretation and enforcement of the norms). The planning and organization of the formation of laws, in as far as they are useful in enabling the legislator to pass legislation, having at his disposal the necessary rime to acquire the required (technical and/or statistical) data and to discuss the related axiological problems, are functional to the rationality of this process. There is a special kind of planning in socialist countries which involves the periodic systematization of certain sectors of the legislation currently in force and results in the elimination of lacunae, inconsistencies, contradictions, superfluous or non-enforced (disused) normative acts. Another kind of planning has, instead, the future task of the formation of laws over long periods of time as its object, taking into account the general development of the State and society. Apart for planning, there are also organizational instruments which can influence the formation of laws beneficially. In Poland, the Commission for Legislative Drafting, the Legislative Council and, for some special aspects, the Ministry of Justice, perform this role. Finally, it is explained that the creation of a specialized legislative information system, aimed at providing complete and reliable information on all of the laws currently in force, on the work of the courts and on the opinions expressed in legal authority, cam be of considerable value in the rational formation of laws.
