Informatics and Legislative Power

L'espressione "potere legislativo" è assunta dall'A. con riferimento sia alla funzione legislativa che all'organo che esplica tale funzione. Quanto a questa seconda accezione si rileva che l'informatica è destinata a incidere profondamente sugli assetti costituzionali degli Stati, in quanto la possibilità che essa offre d'organizzare e rendere accessibile insiemi coerenti di dati (economici, sociali, scientifici, ecc.) e d'elaborare nuovi modelli decisionali, se congiunta con l'ineguale distribuzione degli strumenti informatici tra i poteri costituzionali, rischia di svalutare lo stesso ruolo del Parlamento. In questa prospettiva, attualmente in Europa gli organi legislativi stanno svolgendo un'attività di sistemazione e razionalizzazione delle loro fonti d'informazione, collegandosi anche a banche di dati esterne per quanto riguarda la documentazione economica e statistica. Relativamente ai rapporti tra informatica e funzione legislativa si pongono due interrogativi fondamentali: si tratta cioè di stabilire cosa sia un sistema d'informatica giuridica e cosa esso offra al legislatore. Problemi più specifici, e di natura strettamente giuridica, riguardando la fissazione del termine a quo del sistema informativo e l'individuazione delle norme da immettervi. Appurato che nel sistema informativo è solo possibile immettere le norme promulgate - senza distinzione tra quelle vigenti e quelle non più in vigore -, si evidenzia una situazione di sostanziale "incontrollabilità" dell'ordinamento, cui sarebbe possibile ovviare almeno in parte col ricorso a un'adeguata tecnica legislativa. La fase anteriore alla presentazione del progetto di legge - e quindi la sua redazione - non è regolata da norma e pertanto è attualmente rimessa alla prassi o ai suggerimenti contenuti nell' esigua letteratura sull'argomento. Ogni legge dal punto di vista del contenuto può comprendere, oltre a uno o più enunciati definizioni concettuali o citazioni di norme già promulgate. Sono causa d'indeterminatezza dell' ordinamento l' ambiguità semantica e sintattica degli enunciati, la rarità delle definizioni, l'uso d'un linguaggio non specializzato, il ricorso indisciplinato alla tecnica dei riferimenti. Solo un sistema d'informatica giuridica integrato consentirebbe il controllo permanente dell' ordinamento, fornendo al legislatore gli elementi necessari a migliorare la sua tecnica di produzione delle norme. Infine restano tuttora da affrontare e approfondire i problemi relativi alla realizzazione di sistemi informatici di previsione e simulazione nel campo legislativo e le questioni connesse con l'emanazione di leggi a contenuto amministrativo aventi caratteristiche formali tali da renderle automaticamente applicabili.

The expression «legislative power» is used by the A. in referring to both the legislative function and to the body which carries out that function. In the later sense it is noted that informatics is destined to weigh heavily on the constitutional institutions of the States, since the possibility it offers for organizing and making accessible coherent groups of data (economic, social, scientific, etc.) and for working out new decision-making models, if added to the unequal distribution of the tools of informatics between the constitutional powers, risks the devaluing of the role of Parliament. Within this perspective, the legislative bodies in Europe are, at present, systemizing and rationalizing their sources of information, even linking up with external data banks for economic and statistic documentation. Two fundamental questions are to be put regarding the relationship between informatics and the legislative function: to ascertain what is a legal informatics system and what it offers to the legislator. More specific problems, and of a strictly legal nature, are the fixing of the limit a qua of the information system and the identifying of the norms for introducing into it. Having verified that only promulgated norms can be introduced into the information system - without distinguishing between those in force and those no longer in force - , a situation of substantial «uncontrollability» in the legal order, which it would be possible to dispose of, at least in part, by using a suitable legislative technique, becomes evident. The phase preceding the presentation of a draft bill - and therefore, its drafting - is not regulated by any norms and therefore, at present, accepted practice or suggestions contained in the small amount of literature available on the argument are fallen back on. Every law, from the point of view of its contents, may include, apart from one or more propositions, conceptual definitions or citations of already promulgated norms. Semantic and syntactic ambiguity of the propositions, the scarsity of definitions, the use of non-specialized language, the undisciplined resort to reference techniques are the cause of imprecision in the legal order. Only an integrated legal informatics system would permit the permanent control of the legal order, furnishing the legislator with the necessary elements for improving his technique for the production of norms, Problems relating to forecasting and simulation in the legislative field and the questions connected with the enacting of specific laws having the formal characteristics which make them automatically applicable are still to be faced and examined in depth.
