A United Kingdom Approach to Legal Information: the STATUS Project

Nel campo dell'informazione giuridica si sono sviluppati sistemi di documentazione automatica diversi in relazione al modello normativo esistente: così nei Paesi europei a Civil Law - cioè basati sull'applicazione di un diritto codificato - l'impegno è stato principalmente rivolto verso la costruzione di sistemi in grado di trattare informazioni strutturate, classificate e reperibili mediante parole chiave eventualmente organizzate in speciali vocabolari; nei Paesi a Case Law - cioè a diritto giurisprudenziale -, e in Inghilterra particolarmente, s'è invece cercato soprattutto di creare sistemi che consentano il reperimento del testo originale dei documenti giuridici richiesti usando parole e frasi in linguaggio naturale. Attualmente, però, con l'introduzione d'una legislazione a carattere internazionale da parte di organismi come la CEE, si rende necessario progettare sistemi di reperimento di tipo misto, adatti tanto a documenti in linguaggio naturale che a informazioni precedentemente strutturate. Nell'articolo è descritto il sistema STATUS (STATUte Search), realizzato in Inghilterra per la memorizzazione, l'analisi e il reperimento mediante elaboratore elettronico delle informazioni giuridiche; sono illustrati i problemi relativi alla preparazione dei documenti-origine, alla costruzione della base di dati e alle tecniche di ricerca, nonché gli espedienti tecnici cui s'è fatto ricorso per conciliare le esigenze di rapidità e affidabilità della ricerca con quelle d'un'agevole procedura di correzione e aggiornamento dei dati immessi nel sistema.

In the field of legal information different automated systems have developed in relation to the existing legal systems: in European countries which are under the civil law system, based on the application of a coded set of laws, the aim has been to achieve methods capable of dealing with prestructured information, filed and retrieved by the use of special key-words, which eventually could be organized into a kind of dictionary. Instead, in countries where the case law system exists – and particularly so in Great Britain – system have been sought which would help in the retrieval of the original text of the legal documents, using words and phrases of natural language. At the moment however, as an international legislative system is being developed by the CEE and by other similar organizations, mixed type retrieval system will soon necessary, capable of dealing both with documents in natural language, and in a prestructured form. In the article the STATUS (STATUte Search) system is described, which has been developed in Great Britain for the computerized storing, analysis and retrieval of legal information; the problems dealing with the processing of the original documents are explained, together with the development of data bases and research techniques, and the technical devices used to reconcile the demand for speed and reliability of the retrieval process, together  with the need for a simple method by which the data supplied to the system can readily be corrected and brought up to date.
