Justice and Informatics

Il servizio pubblico della giustizia, per giustificare e mantenere la sua superiorità sui procedimenti della giustizia privata, deve poter assolvere al suo compito in maniera continua, coerente, rapida e inequivoca e, in questa direzione, quello che si richiede è anzitutto un processo di razionalizzazione esterna, strumentale, operativa, quale può derivare dall'applicazione dei metodi propri dell'informatica: archiviazione elettronica, reperimento automatizzato dei dati legislativi, giurisprudenziali e dottrinali, elenchi anagrafici computerizzati, collegamento mediante terminali degli uffici giudiziari a un centro elettronico. Occorre però rilevare che alla innovazione delle attuali forme di gestione del procedimento giudiziario deve corrispondere anche un mutamento degli stessi modelli culturali impiegati nell'ambito della giustizia. Oltre che sotto l'aspetto della utilizzazione delle tecniche informatiche in questo campo, il rapporto tra giustizia e informatica dev'essere considerato anche nel senso dell'esigenza di sottoporre le nuove possibilità aperte all'informazione dell'avvento dei calcolatori ad un controllo giudiziario. Per rendere effettiva e funzionale questa nuova forma di controllo si rende peraltro necessario procedere alla creazione di nuove figure giuridiche e d'un nuovo ufficio del magistrato, sull'esempio del Commissario per la protezione delle informazioni istituito nella regione dell'Assia, nella Repubblica Federale Tedesca, con una legge approvata nell'ottobre del 1970.

Justice as a public service, to justify and maintain its superiority as regards to the proceedings of private justice, must be able to absolve its duties in a manner which is continuous, coherent, rapid and unequivocal; to obtain this what public justice need above all is to undergo a process of external strumental and operational rationalization, such ad would derive by the application of informatics techniques and methods: electronic filing, automated retrieval of statute law, case law and law literature data, computerized registers, direct connection of judiciary offices to an electronic centre by the use of terminals. It should be stressed however that together with the renewation of the present forms of administration of the judiciary proceedings a profound change should brought about the cultural models employed in the field of justice. Apart from a mere utilization of informatics in this field, the relationship between justice and informatics should be carefully arranged so that it might be possible to subordinate the new possibilities opened in the field of information by of the use of computers, to a judicial control. So that this new form of control night function efficiently it would thus be necessary to create some legal institutions and a new magistrate office, as was achieved by the region of Essen in West Germany, which with a law passed in October 1970, decreed the appointment of a Commissioner for the protection of information.
