Artificial Intelligence and Legal Information Systems

L'analisi delle linee di sviluppo dell'informatica giuridica dai suoi inizi a oggi mostra che l'ambito applicativo delle nuove tecnologie s'è andato gradatamente estendendo dai problemi del reperimento dei dati giuridici a quelli della redazione automatica di atti e da questi alla rappresentazione del contenuto delle leggi in un linguaggio formale atto ad agevolare il giurista nel suo lavoro d'interpretazione e applicazione della norma. A quest'ultimo tipo di problemi si ricollegano le ricerche sulla "intelligenza giuridica artificiale" che si occupano dell'analisi del linguaggio naturale e delle tecniche di risoluzione dei problemi. I sistemi di documentazione automatica costituiscono uno strumento imperfetto per l'utente, cui rimane comunque il compito di formulare in maniera appropriata la domanda all'elaboratore e di ricavare dai documenti ottenuti in risposta l'informazione desiderata; in quest'ambito possono essere di grande aiuto le tecniche d'intelligenza artificiale applicate ai problemi di comprensione del linguaggio naturale. E' però ipotizzabile anche un "sistema intelligente" in grado d'indicare la valutazione giuridica d'una data azione, fornendo una vera e propria consulenza legale all'interessato. Per superare le difficoltà che s'incontrano nell'affrontare il problema della simulazione su calcolatore del ragionamento giuridico e dei processi decisionali giuridici s'è fatto ricorso alla logica e all'euristica. Nell'automazione del calcolo logico formale si sono conseguiti importanti risultati, ma, partendo da posizioni antiformalistiche, s'è manifestato il dubbio che il modo di ragionare del giudice sia legittimamente ed esaustivamente riconducibile a rigidi algoritmi deduttivi; di qui è sorta l'esigenza d'applicare le regole euristiche all'analisi di processi induttivi caratteristici dell'attività giuridica. Nonostante le reazioni emotive, metodologiche, politiche e filosofiche all'introduzione delle tecniche dell'intelligenza artificiale nel diritto, e anche se si è ancora lontani da razionalizzazioni rilevanti sul piano pratico, rimane comunque d'indubbio valore l'interesse teorico di queste ricerche.

The analysis of the development of legal informatics from its beginnings until today demonstrates that the areas of application of this new technology have been gradually extending from problems of retrieval of legal data to that of the automatic drafting of acts and from these to the description of the contents of the laws in formal language suitable for facilitating the work of the legal operator in interpreting and applying the norm. Research into legal artificial intelligence is linked to this latter type of problem where the analysis of natural language and problem-solving techniques are involved. Even the best automatic documentation systems are imperfect tools for the user who is, nevertheless, left with the task of formulating in the appropriate manner the question to be put to the computer and of extracting the desired information from the retrieved documents. Artificial intelligence techniques applied to the problems of the understanding of natural language may be of great help in satisfying these requirements. It is, however, possible to hypothesize even an «intelligent system» capable of indicating the legal evaluation of a given action, providing the interested party with real legal advice. In order to overcome the difficulties met in facing the problem for the computer of the simulation of legal reasoning and of decision-making processes, logic and heuristics have been resorted to. Important results have been reached in the computerization of formal logical calculus, but, starting from an antiformalistic position, the doubt has be expressed that the way in which a judge reasons can legitimately and exhaustively lead to rigid, deductive algorithms for which the need has arisen to apply heuristic rules to the analysis of the inductive processes characteristic of legal activity. In spire of emotional, methodological, political and philosophical reactions to the introduction of artificial intelligence techniques into the law and even if it is still a long way from important, practical results, the theoretical importance of this research is, however, of undoubted value.
