Reform of the Criminal Law
in the light of New Information Technologies
La riforma penale di fronte alle nuove tecnologie dell'informazione
New
information technologies have determined the growth of a new form of "computer power" which, like all forms of power, can be the
subject for control or the instrument for domination. This new kind of power, in fact, may be concentrated or spread within a society,
entrusted to the private sector or held as a monopoly by the State, conceived as a cohering element within society or utilized as a tool
for subjugating citizens. The problem of the protection of privacy, therefore, falls within the area of the relationships between the
public and private sectors, between the administration and the administrated, between the impersonal State and the need of the
citizen to safeguard his freedom of creativity. With the objective of guaranteeing the various fundamental rights of the citizen, the
Spanish Constitution of 1978 lays down in Art. 18 that "the law will restrict the use of informatics for guaranteeing the honour and
the privacy of the personal and family lives of citizens and the full exercise of their rights". Rather than recognize a right, this
rule leads to the imposition of restrictions on the use of computers and, if
necessary, means that the provisions of the criminal law be resorted to in cases
where computer crimes are committed. In Spain, the draft of the new Criminal Code and the ratification, on 27 January 1984, of the
European Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data are important steps towards the
enforcement of the protection of privacy.
Le nuove tecnologie dell'informazione hanno determinato anche il sorgere d'una nuova forma di "potere informatico" che, come tutti i poteri, può essere oggetto di controllo o strumento di dominio. Questo nuovo potere, infatti, può essere concentrato o diffuso all'interno d'una società, affidato all'iniziativa privata o riservato al monopolio dello Stato, concepito come elemento di coesione della vita sociale o utilizzato come strumento di sottomissione dei cittadini. Il problema della tutela del diritto alla riservatezza va posto quindi sul terreno dei rapporti tra pubblico e privato, tra Amministrazione e amministrati, tra Stato impersonale ed esigenza del cittadino di salvaguardare la sua libertà creatrice. Al fine di garantire i vari diritti fondamentali del cittadino, tra cui quello alla riservatezza, la Costituzione spagnola del 1978 prescrive all'art. 18 che "la legge limiterà l'uso dell'informatica per garantire l'onore e l'intimità personale e familiare dei cittadini ed il pieno esercizio dei loro diritti". Questa norma, piuttosto che riconoscere un diritto, comporta che vengano posti dei limiti all'uso degli strumenti informatici e, all'occorrenza, che si faccia ricorso alle disposizioni del diritto penale in materia di reati informatici. In Spagna il progetto del nuovo Codice penale e la ratifica, avvenuta il 27 gennaio 1984, del progetto di Convenzione europea in materia di protezione nei confronti dell'elaborazione automatica dei dati a carattere personale hanno segnato un importante progresso verso l'effettività della tutela del diritto alla riservatezza.
