Informatizzazione della Cancelleria della Corte d'Appello del Lavoro dell'Argentina

Computerization of the Labour Appeal Court Registry of Buenos Aires

In questi ultimi anni, in Argentina, nell'ambito dell'organizzazione giudiziaria s'è sviluppato un forte interesse per la realizzazione di moderni sistemi informativi e l'automazione di servizi e procedure. Il processo d'informatizzazione descritto nell'articolo è stato avviato dalla Corte suprema di giustizia con la realizzazione d'un Centro d'informatica presso la Corte d'appello del lavoro. A una prima fase di pianificazione, basata sul rilevamento dei dati statistici afferenti ai vari settori d'interesse, seguirà l'analisi diretta del sistema reale, condotta con la collaborazione personale dei responsabili dei diversi uffici. Per quanto riguarda, in particolare, l'attività degli uffici addetti al rilascio delle procure, problemi notevoli derivavano dall'ingente quantità degli atti da verificare e registrare, confrontata con l'esiguo numero degli impiegati assegnati al servizio. La procedura tradizionalmente adottata è stata sottoposta a un'analisi minuziosa e quindi modificata in relazione alle esigenze di razionalità e precisione dei sistemi informatizzati. L'ingente numero delle cause presentate annualmente presso la Corte d'appello del lavoro ha indotto a progettare nuovi flussi informativi e, quindi, ad avviare un processo d'informatizzazioen graduale, riguardante le varie fasi dell'attività della Cancelleria: accettazione delle istanze, assegnazione delle cause, istruzione delle pratiche, registrazione e invio dei fascicoli. Le domande, redatte dagli interessati su appositi moduli approvati dalla Corte, devono contenere tutti i dati identificativi dell'attore, del convenuto, del rappresentante legale, dell'oggetto della causa, dell'organo giudicante designato e, se richiesto, l'indicazione del valore economico della controversia. L'impiegato che riceve le domande ne controlla la stesura, le protocolla, ne numera i fogli e le consegna all'operatore del Centro d'informatica che provvede a registrare i dati nell'archivio elettronico corrispondente. Sulla base d'un algoritmo appositamente costruito, il sistema effettua, quindi, il sorteggio e l'assegnazione automatica delle cause ai diversi tribunali, ripartendo equamente il carico di lavoro in relazione non soltanto al numero, ma anche all'urgenza e complessità dei procedimenti. Allo stesso modo, anche la documentazione attinente all'istruttoria viene elaborata e redatta secondo regole precise, atte a consentire una notevole semplificazione delle procedure e un immediato reperimento dei dati.

Over the last few years there has been a great deal of interest, in Argentina, within the ambient of judicial organization, in the creation of modern information systems and in the automation of services and procedures. The computerization process described in the article was begun by the Supreme Court of Justice with the installation of a Computer Centre at the Labour Appeal Court. The initial planning phase, based on the collection of statistical data relating to the various sectors of interest, will be followed by the direct analysis of the real system, carried out with those responsible for the different offices collaborating personally. In particular, with regard to the work of the offices in charge of dealing with procurations, considerable problems arise out of the huge quantity of legal documents which must be checked and registered, in comparison with the small number of employees assigned to this service. The procedure which had traditionally been adopted was carefully analysed and modified by making it more rational and precise as necessitated by information systems. The large number of cases presented annually before the Labour Appeal Court led to the planning of new information flows and, therefore, to beginning a gradual computerization process regarding the different phases of the work of the Court Registry: acceptance of the petitions, allocation of the suits, preparation of the cases, and the registration and consignment of the documents. Petitions drafted by interested parties on special forms approved of by the Court must contain all the data which identify the appellant, the respondent, the legal representative, the object of the proceedings, the appointed judicial body and, if requested, the economic value of the dispute must be indicated. The employee who receives the petition checks the way it has been filled out, records it, numbers the pages and hands it on to the Computer Centre operator who loads the data into the relevant data base. On the basis of a specially designed algorithm, the system then automatically sorts and assigns the cases to the different courts, dividing the work load equally not only in relation to the number of cases but also to the urgency and complexity of the proceedings. Similarly, the documentation relating to the preliminary investigation is also processed and drafted in accordance with precise rules, aimed at permitting procedures to the considerably simplified and data to be retrieved immediately.
