fra teoria delle reti e filosofia dell’informazione
Il saggio esamina la rete di citazioni delle decisioni adottate nei procedimenti promossi in via incidentale dalla Corte costituzionale – dalla costruzione della rete alle sue proprietà strutturali più rilevanti. L’analisi è approfondita in termini di informazione. Distinguendo tre livelli di analisi, cioè l’informazione giuridica “per” la realtà, “come” realtà, e “sulla” realtà, un’attenzione particolare è rivolta ad aspetti della conoscenza e dei concetti che inquadrano la rappresentazione e la funzione del sistema giuridico sotto esame.
This paper examines the citation network of the “in via incidentale” rulings of the Italian Constitutional court, from the construction of the network to its most relevant structural properties. The analysis is deepened in terms of information. By distinguishing three levels of analysis, i.e. legal information “for” reality, “as” reality, and “about” reality, special attention is drawn to matters of knowledge and concepts that frame the representation and function of the legal system which is under scrutiny.
